Eligibility.
PartyCheap sweepstakes are open to the members of the Facebook community. Employees, directors, and/or officers (including immediate family members or members of the household) of PartyCheap, its subsidiaries, affiliated companies, distributors, advertising, fulfillment and promotion agencies and all other companies or entities associated with the Sweepstake are not eligible to participate. Participation constitutes entrant’s full and unconditional agreement and acceptance of these Official Rules which will be final in all respects.

How to Enter.
Sweepstakes begins May 1, 2014 and will be ongoing at the discretion of PartyCheap. All entries must be submitted to PartyCheap’s Facebook pages or emailed to [email protected] to be eligible. Entries must be submitted by the last day of every month to be eligible for the monthly drawing. All entries, once submitted, become the property of PartyCheap and shall not be returned. Incomplete entries will not be eligible. Only one entry is allowed per person; multiple submissions will count as one entry within each month. Only one winner per entry period; non-winning entries submitted will carry over to next entry period. Submissions not chosen as winners will be eligible for selection for future months. All Entrants must be a legal resident of, and residing in, one of the 50 United States (excluding Rhode Island) or the District of Columbia. All Entrants must be at least the age of majority or older in their state of residence to be eligible. Sweepstake is void where prohibited or restricted by law.

Winning/Prizes.
One winner will be randomly selected each month. The Winner will receive a $100 gift certificate to be redeemed on PartyCheap.com and cannot be redeemed for cash. PartyCheap shall select all winners at its sole discretion. Winner will be notified via e-mail or Facebook on the last day of the entry month. The odds of winning depend on the number of eligible entries received. The winner will be responsible for any and all taxes. If these rules differ from any promotional or other materials published in connection with the Sweepstakes, these rules shall control.

Prizes are non-transferable. No cash redemption or substitution will be allowed, except at PartyCheap’s sole discretion. If the prize is unavailable, PartyCheap reserves the right to substitute a prize of equal or greater value. PartyCheap also reserves the right to cancel or modify the Sweepstakes or these Official Sweepstake’s Rules if fraud, technical failures or any other factor beyond PartyCheap’s reasonable control impairs the integrity of this Sweepstakes, as determined by PartyCheap, in its sole discretion. By participating, where allowable by law, entrant grants to PartyCheap the worldwide right to publish, broadcast and use in any media, including the World Wide Web, participant’s entry, name, picture, and likeness, without limitation, for promotional and advertising purposes without additional compensation. Winner or winner’s guardian may be required, in the sole discretion of PartyCheap, to sign and return an affidavit of eligibility and a liability release within ten (10) days of the issuance of such documents or the prize may be forfeited and awarded to an alternate winner.

Publicity.
By participating, each entrant grants Sponsor permission to use his/her, entry, name, likeness, or comments for publicity purposes without payment of additional consideration, except where prohibited by law.

Content.
By submitting content, entrant certifies that their content does not infringe on the rights of any third party or violate any state laws. If Sponsor has reasonable suspicion that entrant’s content violates this section, the Official Rules, or Facebook Rules, Sponsor may remove entrant’s content. Sponsor reserves the right to limit the violating entrant’s future participation in the contest.

Liability.
By participating in this Sweepstakes, Entrant accept all risk and consequences of entry and participation in this Sweepstake, and agree to release and hold PartyCheap, its officers, directors, affiliates, employees, contractors, subsidiaries, agents and partners harmless from any and all consequences, liability, losses, damages (including without limitation, consequential, punitive, incidental, special or increased damages and those related to personal injury, death or damage to property) and costs and expenses, of any kind, under any legal theory, arising from or related to this Sweepstakes, including but limited to your entry and participation in this Sweepstakes, the acceptance and/or use (or misuse) of any prize, printing errors, any claims based upon rights of publicity and invasion of privacy. Entrant shall indemnify PartyCheap, its officers, directors, affiliates, contractors, subsidiaries, agents, employees and partners from and against all claims or suits and any damages or costs (including reasonable attorneys’ fees) arising from or relating to entrant’s violation or inaccuracy of any warranties or representations made relating to this Sweepstakes. PartyCheap assumes no responsibility for errors which may occur in the transmission of entrant’s entry. PartyCheap is not responsible for any fraud or misconduct on the part of the entrants. If an entrant engages in fraud or misconduct of any nature, including but not limited to a violation of the Official Rules, such entrant may be immediately disqualified.

In no event shall PartyCheap be liable to Entrant for any lost profits, or for any special, incidental, consequential or other indirect damages arising out of or in connection with this Sweepstake. Entrant’s sole damages shall be limited to entrant’s actual out of pocket expenses, excluding attorneys’ fees. Without limiting the generality of the foregoing, such prizes are provided “as-is” without warranty of any kind, either express or implied, and Sweepstakes entities hereby disclaim all such warranties, including but not limited to, the implied warranties of merchantability, fitness for a particular purposes and/or non-infringement.

Force Majeure.
PartyCheap reserves the right, without prior notice and at any time, to terminate the Sweepstake, in whole or in part, or modify, suspend or extend the Sweepstakes in any way if it determines, in its sole discretion, that the Sweepstakes is impaired or corrupted or that fraud or technical problems, failures or malfunctions have destroyed or severely undermined the integrity or feasibility of the Sweepstakes.

In the event PartyCheap is prevented from continuing with the Sweepstakes as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made health epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal, state, provincial or local government law, order, or regulation, public health crisis, order of any court or jurisdiction, or other cause not reasonably within PartyCheap’s control (each a "Force Majeure" event or occurrence), then subject to any governmental approval which may be required, PartyCheap shall have the right to modify, suspend, extend or terminate the Sweepstakes. Only the type and quantity of Prizes described in these Official Rules will be awarded.

Law.
All issues and disputes regarding any aspect of the Sweepstakes, including, but not limited to the construction, interpretation and enforceability of these official rules, shall be governed by the laws of the Commonwealth of Pennsylvania, without regard to principles of conflicts of laws. All suits and claims shall be brought in a court of competent jurisdiction situated in Harrisburg, Pennsylvania or otherwise agreed by all parties.

Entire Agreement.
These terms set forth the entire agreement between the parties relating to the subject matter hereof, and supersede all prior agreements and understandings relating thereto, whether oral or written. Facebook is neither a sponsor nor an affiliate of this Sweepstake.

Sponsor.
This Sweepstakes is sponsored solely by PartyCheap, 1 Beistle Plaza, Shippensburg, PA 17257. This promotion is in no way sponsored, endorsed, or administered by, or associated with, Facebook. Any questions, comments, or complaints regarding the promotion must be directed to Sponsor, not Facebook. By entering this Sweepstakes, entrant releases Facebook of any and all liability associated with this Sweekstakes.
